Lean On Me Caregiving Pty Ltd (LOMC) is committed to protecting the privacy of our participants, staff, and stakeholders. As an NDIS provider, we handle sensitive health and personal information every day. This statement outlines how we collect, use, and protect your data in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and the NDIS Code of Conduct.
1. The Kinds of Information We Collect
To provide safe and high-quality disability supports, we collect personal and sensitive information, including:
- Identity Data: Name, date of birth, gender, and NDIS number.
- Contact Data: Address, email, and phone numbers.
- Health & Disability Data: Medical history, support plans, reports from specialists (e.g.,Speech Pathologists/Dietitians), and medication requirements.
- Emergency Contact Details: Information regarding your advocates, guardians, or next of kin.
- Financial Data: Billing information and NDIS plan management details.
2. How We Collect Information
We collect information directly from you, your family, or your authorised representatives. We may also collect information from third parties (such as your GP or the NDIA) only when you have provided explicit consent for us to do so.
3. Why We Collect and Use Your Information
We use your information to:
- Assess your needs and develop your Support Plan.
- Deliver core and high-intensity supports (such as Mealtime Management).
- Communicate with you and your support network.
- Comply with NDIS Quality and Safeguards Commission requirements.
- Process payments and manage our business operations.
4. Disclosure of Information
LOMC will only disclose your personal information to third parties when:
- You have given us consent.
- It is necessary to provide the support services (e.g., sharing a mealtime plan with a support worker).
- We are required by law (e.g., mandatory reporting to the NDIS Commission).
- It is necessary to prevent a serious threat to life, health, or safety.
5. Data Security and Storage
We take all reasonable steps to ensure your information is stored securely, whether in physical or digital format. Our digital systems are password-protected and restricted to authorised staff only. We have strict Management of Data Breach policies in place to respond to any unauthorised access.
6. Accessing and Correcting Your Information
You have the right to request access to the personal information we hold about you. If you believe any information we hold is inaccurate, out-of-date, or incomplete, please contact us. We aim to respond to access requests within seven (7) business days.
7. Privacy Complaints
If you have a concern about how we have handled your privacy, you can lodge a complaint via our formal Complaint Handling Process. We treat all privacy complaints seriously and confidentially.
